There still seems to be some confusion amongst property professionals regarding EPC requirements for commercial properties. In order to make sure your client is not breaking the law, or equally if you are acting on behalf of tenants or purchasers, you will be protecting their best interests by ensuring an EPC is made available before exchange of contract.
What are your clients responsibilities when selling or renting a commercial property?
If your client is offering a commercial property for sale or let they will need to make an EPC available. The EPC should be made available at the earliest possibility, no later than when the property is first viewed or when written documents are provided.
What are your responsibilities as a solicitor?
The following extracts are from CPSE.1 (version2.9) general pre-contract enquiries for all commercial property transactions
14.6 Have you supplied a valid Energy Performance Certificate (EPC) for the property, or a copy of it in relation to the Transaction and, if so to Whom?
14.7 If you have not supplied a valid EPC for the property please
(a) tell us where a vailid EPC for the property can be inspected ;or
(b) explain why no EPC is needed.
